Exclusive versus shared delivery - common questions

What firms ask about exclusivity, duplicates and what can actually be written into a scope document.

For attorneys and firm administrators. Injured people should not use this page.

If your question is not here, the criteria conversation is where it gets answered.

  1. Question 01

What does exclusive mean in the scope document?

That the record is delivered to your firm and no other firm. It is written as a term with a stated scope and period, so it can be pointed at later. Anything broader than that is not claimed.

  2. Question 02

Is exclusivity the same as a territory?

No, and conflating them is the usual source of disappointment. A territory limits where inquiries come from. Exclusivity limits who receives them. A test can be written with either, both, or neither, but the document says which.

  3. Question 03

What happens if the same person appears twice?

The duplicate rule decides that, and it is agreed before delivery starts. Firms usually want a credit; the point is that the rule exists in writing rather than being settled by argument the first time it happens.

  4. Question 04

Does exclusivity change the qualifying criteria?

No. Criteria describe which matters you want. Exclusivity describes how a record that meets them is delivered. Both are written before anything is spent, but they answer different questions.

  5. Question 05

Can we test shared and exclusive side by side?

You can test one delivery arrangement at a time and judge it against your own baseline. Running two at once inside one small pilot usually produces two samples too small to tell you anything.

  6. Question 06

    What does this cost?

No figure is quoted until your criteria exist, because the criteria decide what is being delivered. When it is quoted, it is per billable inquiry, with a cap you approve before delivery begins.
