Law firms - the long version
Is the inquiry yours, or is it being worked by three other firms as well?
Exclusive is a contract term, not a tone of voice. It either says so in the scope or it does not.
For attorneys and firm administrators. Injured people should not use this page.
Reading time is about eight minutes. Nothing here quotes a price or promises a result.
The situation
A shared inquiry is a race the firm did not agree to enter, run against firms with larger desks and faster dialers.
Neither model is dishonest. They are different products at different economics, and a firm should know which one it is buying before it reads conversion figures from it.
The only reliable test is the document: what it states about who else receives the same inquiry, and what happens if that is breached.
What shared delivery costs before anyone answers
- Staff time is spent on conversations that were decided before your call connected.
- Answering speed stops being a service standard and becomes the only thing that matters.
- A source that looks weak may simply be a source you were third to.
- Injured people who are called by four firms in an hour trust the fourth one least.
What has to be established before delivery is called exclusive
Exclusivity is a term in a scope document, not an adjective in a sales conversation. These are the parts that make it mean something.
Who else receives it
Whether the record is delivered to any other firm, and whether that is written down anywhere you could point at later.
Exclusive to whom
Exclusive to your firm, or exclusive within your service area, or exclusive for a period. These are different things and only one of them is usually meant.
What happens on a duplicate
If the same person appears twice, what is the rule - credited, replaced, or argued about after the fact.
How you would know
The record has to carry enough detail for your team to recognize a repeat without calling the person to ask.
Establish what you are buying today, then decide whether exclusivity is worth writing into a test.
What you keep
What you hold at the end of this conversation
- 01
A written statement of who receives the record
Named in the scope document before anything is delivered, so it can be held to.
- 02
A duplicate rule you agreed to
Written before delivery starts rather than negotiated the first time it happens.
- 03
A way to check
A record format your intake can match against existing matters without a phone call.
Straight answers
Straight answers
- Is exclusive delivery just more expensive volume?
- It is a different thing being delivered, and the cost is quoted per billable inquiry once the criteria exist. Whether it is worth more to you depends on your own figures, which is why the calculator runs on your numbers rather than ours.
- How would we ever verify it?
- By the record. Each delivered record carries enough detail to be matched against your existing matters, and the duplicate rule states what happens when a match appears. Verification is a process you can run, not a promise you have to take.
- What if the person contacted other firms themselves?
- That happens, and no arrangement can prevent it. Exclusivity covers what is delivered by us, and the scope document says so plainly rather than implying more.
- Do we have to decide this now?
- No. Nothing on this page commits you. The four questions below take about two minutes and tell us what you are comparing against.
Your criteria
Tell us what you are buying today
Four steps on what you currently receive, who else appears to receive it, and what you would need written down before testing anything different.
What happens next
- 01We reply within one business day and propose a time.
- 02We draft your criteria document and send it back for corrections. Nothing is delivered until you approve it.
- 03If we can meet the standard, we quote per billable inquiry. If we cannot, we say so.
We do not sell or share what you submit here, and we do not use it for anything other than responding to your enquiry.
